Ledgerhorn Terms of Service
Last updated: [DATE]
These terms are between you (the subscriber) and [LEGAL ENTITY NAME] ("Ledgerhorn," "we," "us"). By subscribing, you agree to them. We kept them short and plain on purpose. When something here is unclear, we'll read it in your favor.
1. What you get
Ledgerhorn is an email subscription that turns public Austin, Texas records into leads and trends for trade and service businesses. Plans:
- Starter, $29/month or $290/year: a Monday weekly with Austin permit trends and counts by category and area.
- Pro, $69/month or $690/year: everything in Starter, plus daily commercial lead cards, a list of businesses getting ready to open, top contractors and the biggest projects.
- Pro+, $129/month or $1,290/year: everything in Pro, plus filtering by your trade and the full spreadsheet download.
Annual plans cost the same as 10 months (2 months free). Your plan, price and renewal date are shown before you pay and in your receipt.
2. Billing
- Plans renew automatically (monthly or yearly) until you cancel. We'll never charge you without showing the price and renewal date first.
- No setup fees, no hidden fees, no long-term contract.
- If a price ever changes, we'll email you at least 30 days before it applies to you, and you can cancel before then. Annual plans keep their price until renewal.
- Prices don't include any sales tax we're required to collect; any tax is shown before you pay.
- Payments are processed by [PAYMENT PROCESSOR]. We don't see or store your full card number.
3. Cancel any time
Cancel online in a couple of clicks from your account or any billing email, or just reply "cancel" to any Ledgerhorn email. No calls, no forms. You keep your emails until the end of the period you paid for and won't be charged again. We'll confirm by email.
4. Refunds
- First charge: if Ledgerhorn isn't useful, email us within 14 days of your first payment for a full refund. No questions asked.
- Annual plans: cancel within 30 days of an annual charge (first or renewal) for a full refund. After that, ask and we'll refund the unused full months.
- Anytime: if something went wrong on our end (missed emails, a source stopped, a billing mistake), we'll refund or credit you fairly. We'd rather refund than argue.
- Switching plans: upgrades take effect right away and are prorated; downgrades take effect at your next renewal.
5. How you may use the information
You may use Ledgerhorn for your own business: finding work, planning territory, and contacting the businesses, builders and contractors named in it. You may share it with people in your own company.
You may not: - Resell, republish or redistribute the emails or spreadsheet (or large parts of them) outside your company. - Try to identify, locate or contact any resident or homeowner behind a residential entry, or combine our data with other sources to do so. - Call, text, email, door-knock or mail a specific household because it shows up in our data. - Use the data for credit, insurance, employment, housing or tenant decisions. - Use the data in a way that breaks telemarketing, spam or privacy laws.
If you ever come across personal information about a resident through our service, please don't use or share it, delete it, and tell us at [email protected] so we can fix it.
6. Where the data comes from
Our information comes from public records published by government agencies, including the City of Austin, the Texas Alcoholic Beverage Commission and the Texas Comptroller of Public Accounts. We clean, sort and summarize it. Residential activity is shown only in summary form (for example, by block or ZIP), never with homeowner names, phone numbers, permit numbers or exact home addresses. We are not affiliated with or endorsed by any government agency. If a source stops publishing and your plan loses a feature because of it, we'll tell you and refund or credit the difference.
7. Accuracy
Public records can be wrong, late, incomplete or withdrawn, and a filing doesn't guarantee a project will happen or that work is available. We work hard to get it right, but the service is provided "as is" and "as available," without warranties of any kind, including accuracy, completeness, timeliness or fitness for a particular purpose. Please check the original source before relying on an entry for a bid or business decision.
8. Limits on liability
To the extent the law allows, we're not liable for lost profits, lost jobs or bids, or indirect, incidental or consequential damages. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing here limits rights you have that the law doesn't allow to be limited.
9. Suspension
We may suspend or end an account that breaks section 5, especially anything involving residents' privacy. If we end your account for any other reason, we'll refund the unused part of your billing period.
10. Changes to these terms
If we make a change that matters, we'll email you at least 14 days before it takes effect. You can cancel instead and get a refund for any unused time on your plan.
11. Texas law and disputes
These terms are governed by Texas law. Disputes go to the state or federal courts in [COUNTY] County, Texas, and either of us may use small claims court for eligible claims. Before anything formal, please email us. Most things can be fixed with a reply.
